Clarity Terms of Service

Effective from 2026-10-21

These terms govern the use of Clarity by Whooho: the clarity.whooho.it website, the dashboard, subscriptions, the API, the MCP server and the connectors for AI assistants (the "Service"). By creating an account, buying a plan or credits, or using the API, you accept these terms and the privacy policy. The Italian version is the reference text.

1. Who we are

The Service is provided by Alessandro Terracciano, trading as Whooho Digital Experience, with registered office at Via Caruso 21, 80040 Cercola (NA), Italia ("Whooho", "we"). Contact: clarity@whooho.it.

2. The Service

Clarity measures how AI assistants (for example ChatGPT, Gemini, Perplexity, Claude, Grok) talk about a brand and its competitors, shows the sources they cite and suggests improvement actions. It also includes AI-readiness (GEO) website audits, a pay-per-use API and connectors for AI assistants. Available features depend on the chosen plan and on the AI models active at the time.

3. Account

To use the Service you must create an account with accurate information and be of legal age. You are responsible for keeping your password and API keys confidential and for everything done with your account, including actions by team members you invite and by AI assistants you connect. Notify us immediately of any unauthorised use and revoke exposed keys.

If you use the Service on behalf of a company, you confirm you are authorised to bind it to these terms.

4. Plans, prices and payments

BYOK accounts ("bring your own key"): you use your own AI provider API keys and the related costs are charged to you directly by the provider under its terms. You are responsible for the limits and spending set on your provider accounts.

5. API credits and connectors

6. Consumers' right of withdrawal

If you are a consumer (an individual acting outside your trade or profession) you have the right to withdraw within 14 days of purchase under the Italian Consumer Code. Since the Service is digital content and a digital service supplied immediately, at purchase we ask you to consent to immediate performance and to acknowledge that you lose the right of withdrawal once the service has been fully performed or, for digital content, once supply has started. Without that consent, if you withdraw we will refund you minus the part of the service already provided. API credits already used are not refundable.

Business customers (companies, professionals) have no right of withdrawal.

7. Acceptable use

You agree not to:

We may suspend or limit the account in case of breach, abnormal use that puts the Service at risk, or non-payment, notifying you where possible.

8. AI results: limitations

Results depend on answers from third-party AI models, which change over time, may contain errors and are outside our control. Clarity measures and suggests but does not guarantee rankings, citations, visibility or business results. Recommendations are indicative: assess them before applying them. Clarity is not affiliated with OpenAI, Google, Anthropic, Perplexity, xAI or other providers; their trademarks belong to their respective owners.

9. Your content and our rights

The data you enter (brands, prompts, competitors) remains yours. You allow us to use it only to provide the Service, as described in the privacy policy. The software, the Clarity brand, texts and platform-generated reports remain our property; you may use reports for your business and your clients.

We may use aggregated, anonymous data (e.g. average visibility by industry) to improve the Service, without identifying you or your brands.

10. Availability and changes

We do our best to keep the Service available, but interruptions may occur for maintenance, failures or unavailability of AI and payment providers. Unless agreed in a written Enterprise contract, no service level (SLA) is guaranteed. We may modify, add or remove features; if a change substantially reduces the plan you paid for, you may cancel with a refund of the unused part.

11. Liability

To the extent permitted by law, and except for wilful misconduct or gross negligence, our total liability to a business customer for any damage related to the Service is limited to the amounts paid in the previous 12 months, and we are not liable for indirect damages, loss of profit, data or opportunities. Nothing in these terms limits the rights granted to consumers by law.

12. Term and closure

The contract lasts as long as you have an account. You can close your account by writing to clarity@whooho.it. On closure we delete data as described in the privacy policy; remaining credits are refunded only where required by law or if we discontinue the Service through no fault of yours.

13. Changes to these terms

We may update these terms. Significant changes will be notified at least 15 days in advance by email or in the dashboard; if you do not accept them you may cancel before they take effect. The version in force is always on this page.

14. Governing law and jurisdiction

These terms are governed by Italian law. For business customers the Court of Naples has exclusive jurisdiction. For consumers, the court of the consumer's place of residence or domicile has jurisdiction. Before going to court we ask you to write to us to seek an amicable solution.
